EB-5 is appealing over some other visa categories, both temporary and employment-based green card option categories, because of the flexibility and freedom it gives to the applicant or the investor. The EB-5 investor can pursue the Green Card via his or her own investment. They do not have to have an employer go through a sponsorship process, the first step of which is usually called the labor certification or perm process. It is a costly and burdensome process that many employers are not willing to go through for a foreign national. So a foreign national can hold a temporary Visa status like an H1B and then pursue the EB-5 category on their own ability on their own timing while continuing to maintain that underlying status.
