How is EB-5 different than other visa categories?

• Investor-driven application: Unlike employment-based green cards, which require employer sponsorship, the EB-5 program allows foreign nationals to directly invest their capital to secure permanent residency. This eliminates the complexities and potential delays associated with the PERM labor certification process, often a hurdle for foreign workers seeking employer sponsorship.
• Flexibility and independence: The EB-5 program empowers foreign nationals to pursue permanent residency on their own terms. They can initiate the application process independent of an employer’s willingness to sponsor, allowing them to maintain their existing visa status (like H-1B) while pursuing the EB-5 path. This flexibility provides greater control over the immigration timeline.

EB-5 is appealing over some other visa categories, both temporary and employment-based green card option categories, because of the flexibility and freedom it gives to the applicant or the investor. The EB-5 investor can pursue the Green Card via his or her own investment. They do not have to have an employer go through a sponsorship process, the first step of which is usually called the labor certification or perm process. It is a costly and burdensome process that many employers are not willing to go through for a foreign national. So a foreign national can hold a temporary Visa status like an H1B and then pursue the EB-5 category on their own ability on their own timing while continuing to maintain that underlying status.
